Terms of Service

By accessing or using Noelty ("the Service"), you agree to these Terms of Service. If you do not agree to these Terms, you must not use the Service.

1. The Service

Noelty is operated by Maksim Filippovskii as an individual project.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, uninterrupted availability, accuracy, reliability, or non-infringement.

We may modify, suspend, or discontinue any part of the Service at any time without liability.

2. Accounts and acceptable use

You are responsible for your account, lesson content, uploaded materials, and any activity performed through the Service.

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe intellectual property or privacy rights.
• Upload malicious code, spam, or harmful content.
• Harass, abuse, threaten, or discriminate against others.
• Attempt unauthorized access to systems or data.
• Interfere with the stability or security of the Service.
• Use the Service for fraudulent or unlawful purposes.

We reserve the right to remove content or restrict access where reasonably necessary to protect the Service, users, or third parties.

3. Lesson content and student data

Teachers and lesson creators are solely responsible for the legality, accuracy, and appropriateness of lesson materials, student data, and any other content shared through the Service.

Noelty acts only as a platform provider and does not review or endorse lesson content created by users.

4. Student access links

Student access links are unique tokenized links that may grant access to lesson content without requiring student registration.

You are responsible for sharing lesson links only with intended recipients and for maintaining the confidentiality of those links.

Anyone possessing a valid access link may be able to access the associated lesson content.

5. Intellectual property

All Noelty branding, software, platform functionality, and original platform content remain the property of Maksim Filippovskii unless otherwise stated.

You retain ownership of the lesson materials and content you create using the Service.

By uploading or submitting content to the Service, you grant Noelty a limited non-exclusive license to host, process, and display such content solely for the purpose of operating the Service.

6. Payments, donations, and subscriptions

Payments made through Lemon Squeezy or Buy Me a Coffee may include subscriptions, support payments, or voluntary contributions related to the Service.

Payments are processed entirely by third-party payment providers, each governed by their own terms and privacy policies. Noelty does not store payment card details.

Unless otherwise required by applicable law, payments are non-refundable.

We do not guarantee uninterrupted service availability, specific features, or future product updates in exchange for payments or support contributions.

7. Availability and backups

While we aim to provide a reliable service, we do not guarantee uninterrupted availability, permanent storage, or error-free operation.

You are responsible for maintaining backups of important lesson materials and data where necessary.

8. Termination

We reserve the right to suspend, restrict, or terminate access to the Service at any time, with or without notice, if we reasonably believe:

• These Terms have been violated.
• The Service is being used unlawfully or abusively.
• Continued access may cause harm to the platform, users, or third parties.

9. Limitation of liability

To the maximum extent permitted by law, Maksim Filippovskii shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Service, including but not limited to loss of data, loss of profits, business interruption, or security incidents.

In any case, total liability arising from the Service shall not exceed the amount you paid to Noelty during the 12 months preceding the event giving rise to the claim.

10. Governing law

These Terms shall be governed by and interpreted in accordance with the laws of Cyprus, without regard to conflict of law principles.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after updated Terms are published constitutes acceptance of the revised Terms.

Material changes may be announced on the Noelty landing page or through the Service interface.
